Post Got ripped off! Need help!

I really need some help. The intent of this is not to flame the person who screwed me.

Back in October I placed my original 1994 Cobra spoiler on StangTrader, asking $150 for it. About mid November, someone contacted me about it, and wanted to trade me some parts for it. After several days of debating we came to an agreement:
[*] I ship him an Autometer Water Temp Gauge, Autometer Oil Temp Guage, Autometer Clock pod, and my spoiler.[*] He would ship me a brand new, Autometer 5" Monster Tach with Shiftlight.

We made a writen contract which he signed via e-mail. The problem is he is 17. I know that because he is a minor he can legally break of any contract at will, however he has to return my goods. The agreement was that I was to ship the guages and clock pod 2-day air and ship my spoiler UPS ground. Upon receipt of my gauges and pod, he was to ship me the tachomoter. However after he had received the gauges, he told me he would ship the tach after the spoiler arrived.

This kid doesn't know jack sh!t about him Mustang. He claimed the water temp gauge didn't work, yet the person HE HAD install it for him didn't install the sender and used the existed gauge wire to have both guages working at once. I'm sorry the gauge doesn't work that way. After the spoiler arrived he broke contact for over a week. Then he told me he was NOT going to ship me the tach but was going to give me the cash equivilent instead, $250. A week or so later, still nothing... no e-mails. So I started getting on his case... and of course he would never respond.

Once he did respond he told me to go to hell and he is keeping my stuff. After calming down a bit, he told me that the spoiler arrived damaged and it was unusable. I checked with my local UPS shipper and they said I would need to schedule a time with UPS and the guy I shipped it to, so UPS can schedule a time so they can inspect the spoiler and box. This way I get my money back since it was insured.

Now he seemed interested yet never gave me a time nor phone number for UPS to contact him. So I started to follow up, and of course no respose to 4 or 5 e-mails. Then I get ticked off and ask why he didn't reply. He says "I did respond...." which is BS! He has pulled that same 1 liner 4 times now.

So far it has been almost 2 months since i have shipped my gauges, pod, and spoiler, and he has not given payment. I have threatned litigation via a law suit but he doesn't seem to care.

He is out of state... I am in California and he is located in Oklahoma. Is there a way I CAN SUE HIM?

Yeah, minors can get away with a whole lot of crap. If you have his name, you might try going through his parents. In fact, there may be a legal way to get your stuff through the parents. Hopefully some of our members who are more familiar with the finer points of law can give you some help.

You might consider making a road trip. Grow your hair out a bit and don't shave, put on a wife beater shirt, and show up at his house and scare the sheeeet out of him.

OK... here comes my detective side...
OK, if you mailed him the stuff, surely you have an address? Take the address and get a phone number (maybe on the internet or from 1411). Then contact parents on the situation. If that dosnt work, go to Lycos.com and get a map to his house using your address and his! BWHAHAHA!!! JK about that last one.

Threaten that friends from Canada will come down and drag him off to an arctic location. While suffering from -76 F temperatures, he will be forced to live in an igloo and eat raw seal blubber. Once a week he'll be raped by a polar bear and twice a month he'll take a bath the the ocean and dry off with sand paper!

j/k. I would try what RedLilPony mentioned. Maybe this little punks parents will be more affraid of litigation he is.

95mustanggt - It's a good idea you have but exactly HOW would you put a tied up 17 year old boy in the trunk of a mustang? (Im asuming thats how you would do it b/c all great crimes have to have that element!) I would say tie him to your hood but I think a cop might have a problem with that. ohh and it might scratch the paint.

Thanks guys. I was able to contact a local Stanger who has some buddies in the Police Force. We are going to try to get his buddies to pay him a visit and scare him. I have to be very careful that I do not harrass or threaten him in any way, as it can be used against me in court (when & if I sue him).

I have tried to get his phone number from both 411 and several places on the Internet, but I was unable to find anything.

My friend of mine is a paralegal for a good law firm and she will be sending him a certified letter that I intend to sue him and his parents. I will be addressing it to him formally, ie: Mr. Doe. SO hopefully his parents will open it.

There might be a slight problem tho... this kid claimes to own a sucessful business (trading parts I think) and owns his own house. If he does, indeed, own his own house, then I will not be able to contact his parents. And it would be very difficult to issue a subpoena to his parents if this is the case.

BTW 95mustanggt, that sounds like FUN! Are you offering to go get him?

No, the coldest day on record in Edmonton is -61 degrees C or -77.8 Degrees F(plus windchill). The typical "average" cold spell here is a mere -30 to -35 C (-22 to -31 F)(plus wind chill). However the Northwest Territories (a short flight on a 737), DOES get that cold.

Well I have 2 options:

I could be half civil and put my back seats down and tie the bastard up with duct tape and keep him there.

Or

I could mount a ski rack on the roof of my car, you know the covered kind. I could cut a hole in the front and put screen in place so that all the air from driving would rush in the ski rack. I could then duct tape this punk (Man I love duct tape ) and store him up there with rabid shrews. The shrews would cause lots of pain until I got up north were it was cold and then the wind shill from the highway speeds ought to feeze his nuts off to the point he wants to give you your stuff back (with an apology of course).

He lives in Tulsa, OK.

UPDATE!-----

I FINALLY got a hold of the guy who ripped me off. We spoke online, and he claimed he had been in a terrible accident where his buddy is being charged with Vehicular Manslaughtter for killing the other driver. I doubt this is true (it could be) cause he has employed many stall tacticts.

He was still interested in having UPS take a look at the spoler and box only he did not follow the right procedure. He was supposed to give me his phone number so I could fill out the proper paper work wiht UPS which requires the Reciepient's #. Then they would contact him and go to his residence to inspect the box and spoiler... then send mea check.

Well he waited too long so I can't file a claim. He then said he would ship me my stuff back (which he has said numerous times) and then said he had to go and logged off. This is his signature tactic... say that he will return my stuff and then loggs off. Nothing ever gets shipped.

Just thought I should bring you all up to speed!

Hahahaha! Aw, man! Sorry, I'm LMAO at some of the ideas I've seen in this thread.

Anyhoo, how can a 17-year-old own a house and not be subject to lawsuits or criminal prosecution??? Doesn't make sense...then again he's in Okyhoma. I would VERIFY his age, just to be sure you can't sue, through the police or something.

I can't believe he's giving you all of these excuses, dude! I smell #2, and if I were you (just because I'm crazy like this), I'd show up at his doorstep with a chainsaw and say, "WHERE'S MY PARTS, DUDE?!?" Hehehehehe, that usually works to scare people.

Oh, and keep in touch with the paralegal, it's your (next to) best shot.

hehe, cool, I only live about an hour and a half from Tulsa. Where's the little punk at and I'll go get him? Call the police dept. there in Tulsa and file a report on him and tell them you want to press charges. You have his name and address, correct? I figure so since you shipped the stuff to him. He maybe 17 but he can't get away with theft. Do you have any receipts and serial numbers for the stuff you sent him? The UPS records should verify to the police that it was your stuff that was shipped to him. You should be able to get this done. UPS should have it all logged, from your house to his and exactly what was shipped. I imagine he had to sign for it, too.
Also, if you want to find this dudes house here's what you do. You have his address. Go to Tulsa and just ask the police where this address is located and they will tell you. That's what a friend of mine and I did to locate his Saleen spoiler that got delivered to a wrong address. We got the address that it was delivered to, went to the police station and all we did was ask them where we could find this house. They put me on the phone with the local 911 office and they told me how to get right to the front door.

Chainsaw? That would make too much noise (good idea though, it would definately cause him to lose bowel control.) Before you start go to a local porn shop and get some playgirls (you'll see ). I would go to his house with some large freinds of mine, and know on the door. When he answered you could jump him! Wack him with a cheese grater to get some cuts exposed and dump some salt on him (Make sure you duct tape his mouth). Then get a bunch of wiskey bottles and smash them. Dump the broken glass in to his dryier. Shovel the little punk into the dryer with the crushed glass and turn on full heat.

Now pull out those play girls and put up pictures of naked men all over his room. If you have enough you could hide little pictures all though out the house (he'll be finding them for weeks ). Take your stuff and leave. After a couple of hours call 911 from a pay phone and have police and an ambulance sent over. Make sure that there is atleast one centerfold in view of the doorway.

If this doesn't help I'm running out of idea's. . Atleast idea's that don't involve explosives, heh I'm a Minning Engineer . Which is probably a good thing, When I look back on this post, I have to wonder about my sanity. I think I better go for a spin in the mustang and spend some more time here on MW . Work is driving me crazy.

What imaginations! i can guarantee that the local police will not follow-up because its a civil act not criminal. generally minors are not held liable for contracts however, his parents are if the contract is ligit. ie not porno subscriptions but porno long distance calls. If indeed he does have a business ... then is he considered an adult and can be held accountable. The downside is the same dilema that Dan contemplated with his Lightning. The hassle of taking time off from work and such to file in small claims. I can sympathize with your situation but all fellow Stangers PLEASE use COD, credit card or an escrow account when buying from the net.

i once had to sue a guy in calif on the same type of deal it cost me 70 bucks to file and i did not have to show for court only provide my records to the judge. any way the didn't show so i won but.... the scuzball filed bankrupsy on me and he doesn't have to pay. thats ok i did get the last laugh some people i know took a vacation down that way and paid him a visit, no chainsaws or violece but they did get the point across.
i will say be csarful if you choose this route after all you are dealing with a minor.
btw my friends said he already had one black eye..
violence is not the answer, but it sure feels good

What were you using to talk to him online? If it was mIRC you can get his IP address with it. Then use that to find his internet provider (not sure how you do that but I'm sure you can do it). Then call the provider and see if you can find out the name on the account and possibly a phone number (might work if it's a local provider).

If you don't get this settled legally you could have three guys go to his house (one pretending to be blind) and put the fear of God into him by strapping his @ss to the kitchen table with his legs spread. Tell the kid that the blind dude is going to try to drive a nail into the table with a claw hammer very close to his genitalia. Wait until he starts crying like a little baby (if he already is wait until he passes out) before letting him up. Get the parts then beat the sh!t out of the little punk.
