Insurance Company Problems... HELP
My girlfriend was driving my 98 cobra and crashed it into a tree. The car is totaled. I only have liability on my car, I was told by her and her father that she woudl be covered driving my car under her insurance. Her insurance refuses to pay for any of the damage.
Does anyone have any idea on this? The company is USAA.. Thanks Skyler |
My insurance company told me the insurance follows the car, not the driver, my company is Farmers. Sorry to hear about your loss.....

Her insurance should cover your car. If they refuse, put pressure on your company to assist you. Otherwise, you may want to get an attorney IF you want to collect.

Dude You are just SOL if you had full coverage your insurance would have covered her as long as you gave her permission and she had a valid DL. But liability is coverage is just that and since her insurance is not on that car it will not pay.
Personally I think insurance companies should cover the driver and not the car, I have four cars and I spend more money on insurance in a month than what I spend on gas for them. sorry |
I'm afraid I'm gonna have to agree with BigCountryGT.. the insurance is on the car, not the person. If you get her insurance to pay for it, it would be the first time I ever heard of that happening. I hate it for you..
P.S. Why oh why did you not get full coverage on a car like that?? |

Man thats bad. Insurance covers the car only and does not follow the driver.
If the insurance followed the driver I wouldnt have to have seperate policies on all my cars. Good luck man, |
I have Allstate full coverage on my car. My G/F's sister has Liberty Mutual full coverage on her's. As was stated above, both our policies cover the acts of other licensed drivers who have our permission to drive the cars. So even though my GF has no insurance policy of her own, she can safely and legally drive both cars.
I hope this helps and good luck with your terrible situation. Her dad may really be the best way to go. Unfortunately, the family situation may be even more dicey than the insurance one. |

that sucks. I'm realllly sorry to hear about your car! BUT...Im glad your g/f is okay! :) Sorry I cant help ya either ....I pay $145 a month for insurance that would NEVER EVER get me what I've got money wise in my car.. they are crooks. Sky, the only way you are going to get to the bottom of this is to get a copy of her insurance policy and take it to a lawyer. Most lawyers around here will see you the first time for free, just to see if you have a case... blood thirsty bastards! These guys can tell you in about 2 minutes if you have a case. I don't know what the laws are there, they vary so much from state to state, but.. If you do have a case then you can just call the insurance company and tell them you spoke with a lawyer, it makes a difference. If you have a case the insurance company don't want you to know that but if you already know you do then they will negotiate. Good luck brother..

You know what the worst part about it is? They know you're in the right, and they still deny your claim. If I wasn't so worried about you losing your settlement, I'd file a complaint with the insurance commissioner. |
WOW!!! Cool! I'm glad they are covering it. I knew that I'd be covered in a rental car but didn't think I would be covered in someone else's car. That's good coverage!
Ok, before you start getting too excited.. you realize they probably won't want to pay what you paid(I'm guessing between wholesale and trade-in). Also, if its totalled out then they will want what they paid for... the car, as is(don't go making plans on the engine just yet). BTW, where is the car? I hope it isn't behind a fence. I don't know what you have in the car but if you can get to the car and umm... undo whatever you may have done, that would be a good idea... I can only tell you from my experience and it may be different there but here.. the original owner gets the first chance to buy the car back after the claim(yes, I've done it). When the car is totalled out it is sold (at auction usually) to try and recoup some of the cost. Junk yards and cheesy car lots usually end up with these cars, they either fix them or part them out. I don't know what shape that motor is in but I do know there is a 96 cobra not too far from here with a smoking engine(I can only guess why), the asking price is 7k. It has 85k on the clock and its Red(Rio I presume). I figure it would cost about $800 to ship it there... just a thought. GOOD LUCK!! Rick |
