To the Fellow Motorcyclist and everyone else.

Driver sentenced to "acts of kindness" for killing motorcyclist
Feb. 14 – An Oklahoma woman who plowed her SUV into the back of a motorcycle and killed its rider has been ordered to perform "acts of kindness" for 30 months.

In one of the strangest sentences we've heard of for killing a motorcyclist, Tulsa County Special Judge Millie Otey on February 3 sentenced Deana Barnes, 33, to 30-months probation. During that probationary period, the judge will review the case three times to see whether Barnes is "performing acts of kindness or generosity."

If Barnes abides by the requirements of the probation, her record could be wiped clean.

Barnes had pleaded guilty to negligent homicide.

On July 9, Barnes was driving her Ford Expedition at 7 a.m. in Tulsa when she hit motorcyclist Larry Pittman, 34, of Skiatook, Oklahoma, from behind, police said. He died from injuries suffered in the crash.

Pittman was slowing to make a right turn when Barnes hit him. Pittman was thrown from the bike, and then Barnes ran over him, police said.

Explaining the accident, Barnes' lawyer told the Tulsa World newspaper that his client "didn't see him."

Sean Maher, AMA state affairs director, called the sentence "outrageous."

"This is just another example of why we need more consistent sentencing laws around the nation for motorists who kill motorcyclists," Maher said. "There have been successes in some states, but we need motorcyclists to work with us in more statehouses to get new laws passed."

Because of inconsistencies in sentencing around the nation, the AMA has a program called "Motorcyclists Matter" aimed at getting states to pass laws requiring mandatory minimum penalties when a car driver seriously injures, or kills, a motorcyclist, bicyclist, or other vulnerable road user.

I'm in shock that the judge ruled that. Where on earth would you come up with a verdict like that. So sad.

Godspeed to the biker :(

How could a sentence like that be handed out? I wonder sometimes where common sense has gone in the world today :(.

Thats what makes me scared to get a bike :( She deserves to die for killing him. Thats my view. Its obvious she wasnt paying attention. Ive always felt if you kill someone you deserve to die, but there are exceptions. Not here though. That pisses me off that it can even be taken off her record.

hobgoblin351 02-17-2003 07:31 PM

It's not like the guy was shooting gaps or something! Damn they should give her jail time at the least. I didn't see him, what kind of freakin defense is that?! How much did they pay the judge? People who cant drive cars should never try SUV's. At work last week this lady slides her Navigator, into a gas pump. Then she goes screaming into the station about how they didn't plow they snow properly. She wanted to call the cops. I was paying for my gas, turned to her and said thats good then they'll have your name and address on record so they can sue you for the property damage.

The woman who ran the guy over obviously had a lot of money and a good lawyer. With money, you can get away with anything you want in this country. just ask OJ simpson

Nikki, how have you been! Long time!

How did she run over him? I mean she wasnt paying attention, so by the time she hit the brakes, he was already under the vehicle i assume. Yeah i dont buy that "act of kindness" crap, but if she had no intent, i think jailtime would do justice. I dont see killing her if she didnt intend on killing or injuring the person, but i do believe her asz should be behind bars.

All I have to say is a big fat WTF!!!!

84LX89GT 02-18-2003 11:50 AM

WTF!

How can someone KILLING someone out of sheer stupidity get such a light sentance. not only did she hit the bike initially, throwing him FORWARD off the bike, she then ran him over. That's manslaughter, she's not serving ANY time for taking ALL OF HIS TIME AWAY!

....grrrrrr, i'm going to email that judge a piece of my mind!

SlowMopar 02-18-2003 06:51 PM

What the hell?!? If you run someone over it vehicular manslaughter but if you run someone down on a bike it isn't?!? I don't know what the judge was thinking but I don't think she should be were she is.

I've been good. Riding a couple different bikes at the track now and working on restoring a 68 fastback :) Life is good. As soon as we finish the 68 I get to start on my 427 cobra replica ;) Now that I have a stang in the stable again I feel more at home here.

I'm not sure I know what CF.com is, but I recognize your name from the old sportbikes.net board before most of the stunters separated from it, with Fred. I think that's you. I was around when LC's were big around here.

MazdaProwner 02-19-2003 08:52 PM
