Default Serious concerns regarding Tireburner163

About a month ago, I decided to convert my mustang froma C4 to a T5 set-up. Unfortunatley, the post under drivetrain is no longer there. In it, Josh agreed to send me a T5 with less than 30k on it, in very good shape he said, and other parts. I told him I needed to recieve the parts by August 4th in order to do the conversion. He promised several times that would not be a problem, and had the money order in his hands by July 23rd (10 days after postmark). He kept delaying sending it, but again promised it would be there by august 4th. August 4th came and nothing. Later, I recieved some of the other parts postmarked AUGUST 3rd. Since August 4th, Josh has blocked any means to communicate with me and refused to give me his phone number. Today, well over a week after he promised it woudl be here, I recieved the transmission, postmarked AUGUST 10th! Needless to say, I cannot do my conversion now, and it will have to wait a year.

I decided to scrape off the grease encrusted transmission to verify it was solid and much to my dismay I found no less than 2 signficant (more than an inch long) cracks through the shifter box. These were not from shipping because they were poorly sealed with caulk.

Strike three came when I added up the costs for what he shipped me. The total was well under $100, but Josh tacked on $170 for shipping. This is ridiculous. I would love for him to explain himself or defend himself, but since he blocked communication with me, I can do nothing but post here, the forum where he has 4000 posts and whatnot.

Thumbs down Bad faith dealing

Apparently Josh has some explaining to do here.

I hate to see Mustangers (and forum contributors) messing with other Mustangers and cheating thembut so far, we only have one side of the story. That being the case, I would very much like to hear Josh's version of what happened - and why, including why he has blocked communications from Mike, which looks bad.

From Mike's post, it appears that Josh screwed him three different ways: fatal delay in shipping, overcharging and sending a faulty part. That stinks. We assume that longtime contributors to the site are not going to screw over other MW members when they sell tham parts. If that trust is broken, it cheapens everyone involved but mostly the seller who lies about the condition of the part, lies about shipping it on time, sends it too late for the buyers use and then overcharges for a damaged part as well as shipping cost. That's low. I truly hope Josh can supply an explanation but from here, he looks like a thief and a liar and they are not welcomed here or anywhere in the Mustang community.

Josh: the ball is your court. Prove Mike is wrong here. Please.

Outstanding post Mr 5.0...I've been frequenting b-boards for many years and this is by far the best I've seen an admin handle a post like this.

Interesting development ... standing by for the results.

I too, hate to see B-board participants use this as a forum to defraud or screw another member ... SHAMEFUL but, nature of the medium. It would be good to find out there was a huge misunderstanding.

I think if the case is as Mark explains it, a swift action on Josh's part to solve this problem is in order. By a refund? If that makes it right, so be it.

I do remember Marks post asking about the delay. In fact, I wondered where the post went. I searched for it and could not find it. I hope the post didn't get deleted, if anything I see it fair game to have been moved to the Smack House before deletion. I don't see any flaming by Mark's post. So I vote it stays on the boards.

As stated above, the burden of proof is on Josh now.

There's atleast two sides to everything and we've heard one.

Yes... very well put Mr. 5.0, this is only one side of the story at this point.

I did receive email a couple days ago from this member regarding this transaction. I sent private correspondence to Josh regarding this, as something of this nature would be of a serious concern to me... as Josh has been a moderator here for a while. Although not a paid position, or an actual "employee" of the site, a moderator's actions can still reflect on MW... so, anyone could understand my concern. Josh did provide me an explanation, which I received last night. His explanation did sound somewhat understandable regarding a couple of these issues, but did not address them all. However, I will let him respond as it is not my place to speak for him in this.

In any event, my position in the matter is currently neutral until one party shows to an adequate level that I should be otherwise.

I appreciate the support guys, I hope this gets resolved somehow (still cant get more garage time to do the conversion for along time) I'm going to be out of town until Sunday so I wont be around a computer until then, I hope this all gets cleared up.

I really hate to hear this sort of thing.

I don't know what the story is but I'd rather have my name cleared, not to mention conscience, than the money. If I feel like I've done someone wrong it worrys me until I feel I've made it right. Even if I think I'm right and they don't I'd just say "F' it" and take the loss and send the money back, but that's just me. I have a real bad conscience.

I dont necessarily want to make him send my money back and give him the parts back, I mean shipping is so much on this stuff that i feel like its one big waste. I'm going to have to wait a long time to use these parts, but hey, what car guy doesnt like extra parts hanging around Do you think it might be reasonable for me to take the transmission to my transmission guy and have him fix the shifter box and the sloppy input shaft (which i just discovered) and ask Josh to take that bill? That would probably be just as much as shipping it all back. Additionally, sending him the bill from the trans guy, would be the some physical evidence, since right now you guys are taking this on trust (I guess I coudl scan in the postmarks and send you the IM conversations). Honestly, after all this, if i had a working transmission and an apology, I'd be happy.

I hope you two can come to some agreement. We don't even know both sides and may not ever know. If it were me you were dealing with then I'd just send you the money back or whatever it took to make you happy, just to wash my hands of the whole thing. But that's me, I have a serious conscience..

Did you ever talk to TIREBURNER personally, before this transaction...i.e phone call or anything like that?
For all we know, it might not even be Josh who set up this whole deal. It could have been anyone in the family or who had acess to his computer. Hell, Josh could be a 1000 miles away on vacation somewhere and not even know what's going on.
I always like to cover all the scenerios before taking definate action.

It's just something to consider.

Damn, I'm sorry to hear about this.

If I had read it a few days ago, I would have knocked some since into the boy at corral day yesterday.

He's really a good guy, and there has to be somewhat of an explanation for this.

My only comment is that when you buy used parts from a website classifieds, you usually get what you pay for. Its almost always a crapshoot on whether or not the part is going to be in good shape or not. Although Josh said it was in good condition. But you never know, those Mississippian's have different opinions on what a good part is and is not

He was in Bowling Green for Corralday the past few days, and I think he was making the drive back starting sometime this morning. So if he doesn't reply soon, I'll give him a call and see what the hell is going on

That is very disappointing to hear. It is sad to see this happen to a fellow Stanger, especailly by a longtime MW member.

I'll still give Josh some time to reply before I pass judgement, but the longer he waits to offer up his side of the story, the worse it looks
