Default What should I do? All Opinions are requested!

I just purchased a vehicle about a month or so ago. Today I went to pick up the registration and permanent license plates. When I got the registration, I noticed that it is a SALVAGE title!!

I was not told about this when I bought it from the dealership. Is there anything I can do about this? I can't find anything on the Arizona MVD website, but it's not exactly an easy website to navigate either.

Any and all suggestions are greatly appreciated.

Thanks,
Dave

If the dealer sold you the car without telling you it was salvage, and he knew, it seems to be a fraudulant transaction.

I would talk to the dealer, if he refuses to satisfy you, contact an attorney.

http://www.azleg.state.az.us/ars/28/title28.htm

Article 3 covers your issue...It is Specific to Arizona..Read first..and then see if you have a case...

Good luck Friend... That really sucks...Maybe next time you can get a buddy to run a title search on the VIN before your purchase the car.

BTW: Nice looking ride.. Wonder what the issue was...Salvaged titles are not always the WORST thing..depends on what happened and what you are going to do with the car. Insuring it again will be difficult at best.

Note:
VC Section 28-2091.
O. Any person who sells a vehicle for which a salvage certificate of title has been issued and who knows a salvage certificate of title has been issued for the vehicle shall disclose to the buyer before completion of the sale that the vehicle is a salvage vehicle.

VC Section 28-2091
T:4. "Salvage vehicle" means a vehicle, other than a nonrepairable vehicle, of a type that is subject to titling and registration pursuant to this chapter and that has been stolen, wrecked, destroyed, flood or water damaged or otherwise damaged to the extent that the owner, leasing company, financial institution or insurance company that insured the vehicle considers it uneconomical to repair the vehicle.

well it's not the stang in my avatar. I actually had to sell that stang to get the truck I have now, which is the vehicle I'm talking about.

I called the dealer that I bought it from, and spoke to the owner. He said he'll ask the salesman who sold it to me and find out whether or not he knew it was a salvage title.

I asked the salesman before I bought it and he said it was not a salvage title. In all fairness I know they only had this truck on the lot for a day (it was a trade in), but still I think he shouldn't have told me it wasn't a salvage title if he didn't know for sure.

Thanks again,
Dave

They said they'll give me 300 dollars. That's it. What a bunch of crap!!! I guess I'll have to contact my lawyer.

I'm not exactly sure how the laws work out there, but I would guess it's basically the same. My ex and I had a similar situation happen. To make a long story short, he bought a corvette from a dealership out here... I got into an accident in it, and when they totaled the car out found out that there was a salvage title on the car. Here it is the dealerships responsibility to give you that information and in fact you sign a form stating you are aware of that. The dealer had only had that car on the lot for a day as well. We went back to the dealership told them this and they made a deal with us really fast. The problem with the salvage title that we learned the hard way is that it's all fine and dandy until you (god forbid) get into an accident. Then insurance companies will NOT pay out what the car is worth if it wasn't salvaged, and you lose thousands. The difference for us was $7,000. The dealership ended up writing us a check for $9,500 when all of that happened hoping that would keep us quiet. Regardless, if I were you I would go back and tell them you don't want the car and threaten them with an attorny if they don't do as you say. What they did I know is illegal here in Illinois, not exactly sure there, but I would assume. Good luck and be tough! Hope this helps a little.

they said the only other option is to bring it back to them and they'll happily finance us on a newer (more expensive) vehicle.

I still like the truck, and since it's my only vehicle now, I can't really afford to just take it back. I just don't want to have to pay as much for it because it's not worth it. I can never trade it in on a new car, and if I sell it I'm not going to get anything close to what I'm paying for it. And if it gets wrecked, I probably won't get anything for it either.

They don't have anything else there that we like. We're limited to what we can get because I've got a family of 6. The truck I just bought seats 8. As stated above by "Janeofalltrades":

VC Section 28-2091.
O. Any person who sells a vehicle for which a salvage certificate of title has been issued and who knows a salvage certificate of title has been issued for the vehicle shall disclose to the buyer before completion of the sale that the vehicle is a salvage vehicle.

The catch there is that it says "and who knows a salvage certificate of title has been issued".

They say they didn't know because they didn't get the title for four weeks (yesterday). However that doesn't make sense either because when I traded in my stang, they had me sign the title over right then and there.

I'm not sure what you're willing to do, but I know here that dealership is responsible for disclosing that information to you regardless of whether or not that car has been sitting on the lot for a day or a month. Trust me when I say, they can find out whether that car has a salvage title in 2 minutes. They're just tryin to cut a few corners. It doesn't take them 4 weeks to find out whether or not the cars been in an accident. Just my opinion but I would keep pushing for a lot more off that car if you're taking it, because once you leave with it, it will be worth hardly anything. I've dealt with dealerships with this, and they're pushing you to see how much they're gonna get out of you.

I agree with MissBlonie 100% on this issue. They knew the truck was a salvage when they bought it, they're not gonna buy it otherwise. Take the truck back and find something else or find something else and take the truck back ASAP! You do not want that truck at the retail price, believe me.. I don't care why it has a salvage title. A salvaged car is worth about half, if that, what a regular car is. They are making thousands off of the deal or.. they really didn't know in which case, they will be taking it back to where they got it (Believe me). The laws here in NC holds the dealership responsible. Check the paperwork you signed at the closing of the deal and make sure you didn't sign anything that says it was damaged over 25%. Dealerships don't handle salvaged cars around here, not the respectible ones anyhow.

What year truck is it and what did you pay for it?

The answer to that first part is Bull Sh** !!
The answer to the second part is the same as the answer to the first part.
They knew, trust me they knew. There is not a used car salesman on this planet that you could sell a car with a salvage title to without them knowing it before they gave you a dime.
I don't know of any state where you don't have to disclose a veh with a salvage title before sale. They are just testing you to see how much noise you'll make. If you really press the issue i'll bet a dollar to a donut they'll fold and take the truck back. Also it could be a recovered theft (i get them all the time without a mark on them) or it could be a total disaster that someone has patched back together. In Calif it has to be inspected by the CHP before its put back on the road if it has a salvage title so you might want to check that. Whatever you do, i'd do it soon !
PS: the value of that vehicle with a salvage title is just about half of normal !

Don't let them sucker you into another more expensive vehicle. Call the attorney general NOW!!! Unless you have it in writing from the dealer they will lose. I work at a car dealer for 33 years. The attorney general breaks our b#lls about stupid things all the time. You have a legitmate case. Settle for nothing less than a full refund.
I just spoke to my Used Car Mgr. He said if it's not stated on the buyers order, they lose. It's a $10,000.00 fine in the state of PA. I know you sign a lot of papers when you purchase a car. Check the buyers orde and see if it's on there. If it's not call the attorney general. They will investigate and if you win you will recieve a sizable refund or be able to return the vehicle. Beleive me the dealer doesn't want the attorney general snooping around his books.
We just had to refund $25,000.00 because a person bought a used car from us and we didn't have it written on the buyers order that it was an x rental car. We had to refund every customer that bought an x retail car for the last year. Now it's clearly stated on our buyers order when we sell an x rental car.

Just a thought - I wouldn't want to seat 8 of my family/friends in a salvage vehicle that may not hold up the way it should in the event of an accident...I would make them take it back.

Well here's what happened. He offered me a much lower price, or we could just unwind the deal and I'd get my car back. The problem with that is that the high school kid that has my stang now has no idea how to drive it. He's been grinding gears and riding the clutch all over town for about two weeks now. I don't even want the car back, and I really like this truck. He had nothing else on his lot that would suit our needs.

So I took the lower price. According to kelley blue book www.kbb.com, it's still worth a little over 3k with a salvage title, and that's what I told him I'd pay for it. He then offered me what he paid for it and we agreed. It's still a little more than I wanted to pay, but in the long run, it's probably cheaper this way because of court fees and hassles.

As far as the truck damage, I know where it was hit. The front passenger side corner was hit. If I take off the grill and headlights, I can tell where it was mended. The frame seems to be fine. I took it to a collision specialist and asked him the integrity of this truck before I decided to keep it. It costed me some cash, and a boring day with no ride, but it was well worth it.

Another wierd thing is that both carfax and autocheck don't list this truck as being a salvage vehicle???

Thanks again to all,

Dave

I know Carfax has a $5,000 clean history guarantee - not exactly sure how it works, but if you run their report (most likely has to be before you buy a vehicle) and it comes up clean on their report - and you later find out is is a Salvage vehicle, they will write you a check for $5,000...maybe worth looking into.
