Default EGR problem, block or not?

Well, after my explorer intake install, my car was running funny, but only after it was warm, i ran codes and it threw some egr codes.
the idle will surge horribly, when i prop it open (the egr valve) with a screwdriver, it clears up?
so that tells me the egr is not working properly(stuck), so i put an old one on, and it did the same thing?
My question is, instead of buying an egr, can i just block it off since most of the emmissions stuff is disabled anyway?

But it seems to run like crap when it is closed? so if i put a blockoff on it, wouldnt it do the same thing? what to do?
thnx
