Legal Help!!

So i live in an a townhouse complex with a garage. Now The homeowners association put out new rules at the begining of the year saying that "unless for loading and unloading" that it is not alloud that you park your car in front of your townhouse/garage. Your are also not alloud to park in the guest parking lot in the complex. Residents must park in the garage or on the street (very buisy...not cool)

so i get this letter in the mail today saying that i owe 250$$. That i have been "given may notices and warnings" and i violated the rule on april 28, 29 and may 5,6, ad 7. He gives no specifics: what car, what time, for hol long, if it was in the lot or in front of the garage, the liscence plate. For one times i think i was driving a car that wasnt even mine. Now can he just withhold 250 out of the security deposit?? What should i do?? Small claims court.

I know his name, adress, phone, and email, but i dont think im pissed enough to do something like that yet.

You have a situation found in many of these communities that have a Homeowner's Association. To my way of thinking, it's as bad as living in a police state. They limit your recourse and you're stuck with their decision(s).

Fortunately, I have been able to make a choice NOT to ever buy into such a community. When I buy a home, I don't want some bunch of "Do-Gooders" telling me exactly what I can and cannot do to, or with my residence.

Seems like the only thing you can do, is go to the proper "Authority" in your association and find out exactly what crime you committed and how you can resolve the situation.

Don't go with a bad attitude, it'll make things worse, as it sounds like the association Gods are a bunch of anal orifices.

talk with the guy nicley, if he sticks, say well if we cant resolve it we can go to court, still nicely. If he still bitches go to small claims court.

They may not be letting you park in front of your Condo because of Fire Ordinances. The street has to be a certain width in order for Fire engines to be able to get by. This happened to me some years back when I lived in a gated community...

Or the Association is just a bunch of Hitlers...

Many "rules" have to be voted on by the association and should be agreed upon by all members, did you agree? Also, once "rules" are agreed upon, they are usually submitted to the associations legal counsel for review and then placed in record of the county you live in, that way when you do violate the "rules", they can sue you for the fines. That's what we do in Maryland (some parts)
I suggest that you study the "rules" and buy yourself the following: binoculars, video camera, pen and paper, and a good camera. I had a neighborhood "Nazi" in my hood, the above straightened her a$$ out!
