I also think he could sue them but he doesn't have the money to do that. I think he would have a strong case since the clutch he bought was designed for 405 HP and his car only has around 300. He did just that as we are both looking for a Fox Mustang right now.

As far as the procedure thing, Chris has proof that the part failed in the part itself. The Judge could not discard this fact from the assumptions of the dealer that the part was abused. This is what I meant by that. The dealer would have to prove the part was abused and they have no way to prove that. The fact that the part failed is not a proof of abuse but a proof of failure. His contact surface was very nice and even (nice as in nicely rough).

As far as I am concerned personally, I have abused my centerforce clutch a lot at the track and doing burnouts on a regular basis. I raced the car all the time. Did it fail? Nope. Chris doesn't abuse his car half as bad as I abused mine. This clutch shouldn't have failed and the dealer knows it.

I agree with you, if a company doesn't live up to my expectations I just go somewhere else. And that's what I did.
