Default Insurance Company Problems... HELP

My girlfriend was driving my 98 cobra and crashed it into a tree. The car is totaled. I only have liability on my car, I was told by her and her father that she woudl be covered driving my car under her insurance. Her insurance refuses to pay for any of the damage.

Does anyone have any idea on this?

The company is USAA..

My insurance company told me the insurance follows the car, not the driver, my company is Farmers. Sorry to hear about your loss.....

Her insurance should cover your car. If they refuse, put pressure on your company to assist you. Otherwise, you may want to get an attorney IF you want to collect.

Dude You are just SOL if you had full coverage your insurance would have covered her as long as you gave her permission and she had a valid DL. But liability is coverage is just that and since her insurance is not on that car it will not pay.

Personally I think insurance companies should cover the driver and not the car, I have four cars and I spend more money on insurance in a month than what I spend on gas for them.

I'm afraid I'm gonna have to agree with BigCountryGT.. the insurance is on the car, not the person. If you get her insurance to pay for it, it would be the first time I ever heard of that happening. I hate it for you..

P.S. Why oh why did you not get full coverage on a car like that??

The only idea I have is a bad one.

Lean on the old man. Tell him the only reason she ever drove it is because you took his word there would be full coverage. He needs to help you with the uncooperative insurance company.

Sorry about that man. BTW, can I buy the Koni's off you?

Man thats bad. Insurance covers the car only and does not follow the driver.

If the insurance followed the driver I wouldnt have to have seperate policies on all my cars.

I have Allstate full coverage on my car. My G/F's sister has Liberty Mutual full coverage on her's. As was stated above, both our policies cover the acts of other licensed drivers who have our permission to drive the cars. So even though my GF has no insurance policy of her own, she can safely and legally drive both cars.

I hope this helps and good luck with your terrible situation. Her dad may really be the best way to go. Unfortunately, the family situation may be even more dicey than the insurance one.

I am workin it out guys, I'll keep you updated. I have to say I postd this on the corral too, bunch of aholes over there.

Anyways Deuce Yeah I will sell you the konis off the car if you want. Its got bbk lowering springs too that complementd them well and rear control arms.

Auto insurance does follow the car, and not the driver, unless you're renting. This is why many policies expressly forbid people who are not listed on the insurance policy to drive the car.

A. Yes, in most cases your insurance will cover you if the insurance on the vehicle is adequate. But there are some exceptions.



Q. Am I covered if I rent a vehicle? Do I need to buy the insurance the rental company sells?
A. Again, it’s a good idea to talk this over with your insurance company and the rental company before you make a decision. The answer varies from state to state and the laws regulating rental car insurance change frequently.

In general, if you rent a vehicle for a two-week vacation, your own insurance will cover you in that vehicle just as it would cover you in your own vehicle.


Collision Coverage:
Collision Damage to your vehicle or a vehicle you are operating caused by a collision or rollover.

Sorry I cant help ya either ....I pay $145 a month for insurance that would NEVER EVER get me what I've got money wise in my car.. they are crooks. I hope you can get the compensation you deserve!

Sky, the only way you are going to get to the bottom of this is to get a copy of her insurance policy and take it to a lawyer. Most lawyers around here will see you the first time for free, just to see if you have a case... blood thirsty bastards! These guys can tell you in about 2 minutes if you have a case. I don't know what the laws are there, they vary so much from state to state, but.. If you do have a case then you can just call the insurance company and tell them you spoke with a lawyer, it makes a difference. If you have a case the insurance company don't want you to know that but if you already know you do then they will negotiate. Good luck brother..

See a lawyer ASAP, his advice is right on the nose. I lent my car to some *** in college, he supposidly got rear ended and then the driver took off. He tried to make my insurance cover it... Lucky for me his dad was a politician and didn't want the scandel my lawyer was going to make.

Good luck with it. If you need a referral let me know, we have a great lawyer in Ventura.
