bought a new belt for 5.0 last night...they gave me the wrong one so I went back first thing this morning(Advanced Auto Parts) they didnt have the right one...so I tooled on down to autozone..pulled in the parking lot and headed for a parking spot...a guy was backing out and never even looked back to see my beautiful new 1990 Mustang LX 5.0...new hood fender and bumper...his fault...this blow I cant even drive it cuz the wheel rubs BAD and I cant open my pass. door...this sucks...(but im thinkin I might get a Cobra R Hood With SVOP Scoop out of it)....

That sucks man. Just goes to show that you can be the most careful person in the world but you still have to watch out for all the Morons in the world. Hop you get her fixed soon!!

Review of the driving rules and regulations here would make it your fault, not his.

People backing out of a parking space have the right away over through traffic because of events just like this one. It's difficult to see who's behind you, but because of reverse lights, the person passing through can see who's backing up easily.

Do you always just force your way through parking lots? Were you looking for people backing up?

Sorry, but in my cars I keep a look out for who's backing up, I know the rules, and I stay out of harms way. Even if it costs me 10sec before I park.

Hope the laws are different there. I hate having accident crap on my record. Good luck!

I was stopped at the time of collision and the cops said it was his fault

At least in Texas, the onus is always on the person backing out. And as it should be IMHO.

it is his fault, but in florida we have a "no fault" law for little accidents like these...it sucks major ***.. :mad:...sorry man, glad you might benefit from it...

Okay, you made it sound like you were driving through. Since you were stopped, although I can't imagine why you'd stop directly behind somebody while proceeding to a parking spot, you occupied the space first, and you had the right of way. If you are driving through, the law here (and rightfully so) states you are to yield right of way. Mainly the law is in place because when backing out, you cannot see traffic coming from the sides behind you as other cars obstruct your view. Too many people zip through parking lots like it's a racetrack. If you're backing out and Emerson Fittapaldi doing 25mph in his Geo Metro can't avoid you, it becomes an accident.

In Kentucky, it would appear not to be the case. I feel it's naive to expect a person in a parking space to be able to see through cars, but the x-ray vision of a Kentucky citizen makes it a prudent law.

Statute 189.440 Starting a Parked Vehicle

No person shall start a vehicle that is stopped or parked unless and until the movement can be made with reasonable safety.

Effective October 1, 1942
History Recodified 1942 Ky. Acts ch. 208, sec 1, effective October 1, 1942, from Ky Stat. sec. 2379g-69o.

This would be the statue directly responsible for making the other guy at fault.

State law does not apply on private property in Tennessee. Its a free for all. Most insurance companys because of court decisions, side with the person pulling through, as having the right of way.

Saying that, you still can not plow through and (Cause a wreck.)

Alot of the wrecks are usually paid by each persons ins. to fix there own car.

The only things I can inforce are public safety citations. (Reckless Etc..)

Sorry about your car. Parking lots remind me of "Mine fields." Walmart has the bigest one of all, STAY AWAY!

ok unit....I pulled into the parking lot saw him backing so I stopped..insted of him backing and cutting the wheels and pulling forward he kept backing as to totaly straighten out before proceeding forward where in turn by never looking back he hit me no I wans t zipping through a parking lot I WAS STOPPED, the police report states that it was NOT my fault and I dont really care what the laws are where you live...all I care about is the laws here and getting my car fixed...thank you have a nice day

I didn't say you were zipping through the parking lot. You were stopped, so I think that would be an oxymoron. I already said it wasn't your fault because you occupied the space before he started backing. I was more or less remarking on the extremely current parking lot guidlines that were established during World War II, and then I noted why the law should be considered a little flawed.

Sorry to hear about your car getting smashed up, and I apologize for coming across as though I felt you were responsible after your clarification.

I know it dont look bad but the car has been wrecked before and the hood has bondo on it already....dad says most places wont RE-fix a bondoed area...looks like a Cobra R With SVO scoop then....DARN (taken at night I know its not a good pic)

After reviewing all the posts. I cant figure out why did you go to Abvanced Auto,,AH,,,then went back,,AH,,,again..

The Ford gods were watching and evidently got pissed.

Seems like Abvanced should shell out the repair bill:)
