Question Anyone good with law? Need help.

Over a year ago, Lee had a wreck. We were making a left turn on a blind hill ,when: BAM! This bi-- who was doing way over the 35 mph speed limit - hit us. The cop neglected to write down that she slid 40 feet & knocked us 10 feet. Well, we just got papers today that this crackhead is suing us for 300,000. Yeah right. Lee didn't get a ticket & my ins tried to settle her med. bills but they refused, wouldn't send them anything. hahaha

I have pic's of Miss Rockhead walking around after the wreck, she's been to doctors in 4 different countys.

My insurance company told me to send all court summons to them plus the pic's.

If you were making a legal left turn and Odie didn't receive a ticket, that's in your favor.
If the other driver (Miss Crackhead) did receive a ticket, that's even better.

Just send everything on to the insurance company - they'll investigate it and if she's faking, they'll either offer her a low figure to settle it or nothing at all and let her lawyer try to win in court.

That's what you pay those premiums for, to let the insurance company sweat it out when you're involved in an accident.

People filing lawsuits always throw around huge numbers, it's a bargaining ploy. Don't let it scare you. This has become a lot of people's method to 'win the lottery' but insurance companies don't pay out that easily and a actual court case can take five years to come to trial.

Stay in touch with the claim investigator and know what's happening but the company can agree to settle for anything up to your policy liability limits (including medical). It's their money.

thank's mr 5.0, im not worried i have pic's they dont ,my ins tried to settle the medical bill's but they told them they were not going to send them to the ins co. haha 300,000 buck's i will quit my job , burn my house etc, my ins told me to send them the paperwork & their lawyer's will be on it , thank's jim

Was Miss Crackhead on crack at the time of the accident? Her suit would be far over the limit for small claims court, and even if she wasn't ticketed (which I can't believe she wasn't) she'll never win. Even if she does, your insurance company is obligated to pay.

This one is all covered. No problem.

i dont know unit ,i asked her twice if she was ok ,she said yes, she even burned out when she left i have pic's she dont ,the cop was covering for her all the way , probably visiting while her hubby is at work-hehe but my ins told me to send them everything ,including pic's, god i cant stand dope addict's, thank's kell

Forgot to ask; Did your insurance company pay for her vehicle damages?

If so, that's an admission of liability on their part. If they didn't pay, or her insurance company paid for your damages, that's an admission of liability on her company's part and she would have no case at all.

It can happen.

I had a minor accident some years back and the other driver (pulled out of a driveway in front of me - on a main road) received a ticket (I didn't) and her insurance company paid to have my car repaired, no questions asked.

Months later, I received a letter from some law firm that informed me that she was going to institute a lawsuit against me for injuries received in the accident.

I called my insurance company claim agent - he checked the file and saw that her company paid my damages and that she received a ticket so we both had a good laugh. Then he said: "Send it to me, we'll blow them off quick'.

Never heard anything again.

Sometimes people file these 'nuisance' lawsuits to get a quick and easy five or ten-thousand out of the insurance company. The companies often settle because it's cheaper than a trial and they can't afford to really investigate every single case, as they have thousands of claims very year.

If you have photos you've done their work for them and they probably won't settle, unless she agrees to a tiny fraction of what she asked for. Maybe not even then. Insurance companies can be real SOB's and contrary to what many people think, they don't hand you money just because you had an accident and claim you were injured. It happens, but not a lot; otherwise, insurance premiums would be even higher than they are now.

Considering GT Lee's illness, I would consider counter-suing for emotional trauma and aggrevation of her condition brought on by the stress of the accident and the lawsuit.
You would be surprised what a good lawyer could do with that if you were inclined to go that route, which I suspect you aren't. Just a thought. Remember, lawsuits can go two ways.

My company did pay for her car but, Lee didn't get a ticket. I have witness that will testify that she said she was O.K. but she went to 4 different doctors for a year now & only one prescription.

She said we were negligent in operating our car-we were stopped - she also put reckless driving - once again, we were stopped! Then they refused to send my insurance co any info & refused to settle. She didn't get a ticket either but she should have. You're right ; I'm not inclined to sue these moron's unless they keep it up.
