Default Deliberate?

In Texas law, it matters if it was a deliberate act or a crime of passion. Even though our state is famous for meting out the death penalty, that only happens for deliberate acts (crimes that were planned out).

To me me it was fairly obvious that she did not plan the killing. She just lost it with the oppertunity to mow him down inthe parking lot. To me it was a pure "crime of passion" and the 20 years is a perfect punishment for that action.
