Default welding H-pipe question

I was wondering if i'd have any problems if i welded the cross-over on my offroad h-pipe to join the two sides. It appears that the clamp isn't holding hard enough because there are slide (scratch) marks in the crossover area and there is a small leak because of the clamp. I don't want to tighten it anymore because it's on there pretty tight. and it's not leaking a whole lot, but i can hear it when shifting and it's annoying and i don't want to bend the tube because of overtightening and make it worse.

Is it a good idea to weld the crossover completely so there's no movement between the two?
